1) Overview

These Terms of Service (“Terms”) govern your access to and use of the website located at www.flathat.com and any related services, sales, and support (collectively, the “Services”). By accessing or purchasing from our site, you agree to these Terms and our Privacy Policy and Refund Policy.

2) Eligibility & Account

You must be at least 18 years old and legally capable of forming a contract. You are responsible for maintaining the confidentiality of your account and for all activity under your account.

3) Product Information & Availability

We specialize in professional simulation equipment and related accessories. Product descriptions, specifications, compatibility notes, lead times, and availability are provided to the best of our knowledge and may change without notice due to manufacturer updates or supply chain factors. Always review the “Specifications,” “Compatibility,” and “What’s Included” sections on each product page before purchase.

4) Pricing, Taxes & Promotions

Prices are shown in U.S. dollars unless noted. Taxes, shipping, and handling are calculated at checkout based on your delivery address and selected service. We reserve the right to correct pricing or availability errors and to cancel any order affected by such errors; if your payment has been captured, you will receive a prompt refund.

5) Orders & Acceptance

Your order is an offer to buy. We may accept or decline orders at our discretion, including due to verification issues, product availability, or suspected fraud. If we cannot fulfill an order, we will cancel and refund any collected payment.

6) Payments

We accept the payment methods shown at checkout. By submitting payment, you represent that you are authorized to use the selected method and you authorize us (or our payment processor) to charge the full order amount, including applicable taxes, shipping, and fees.

7) Shipping, Delivery & Risk of Loss

Shipping options and estimates appear at checkout. Large items may ship freight. Title and risk of loss transfer upon delivery to the carrier. Delivery dates are estimates and not guaranteed. For freight shipments, you must inspect the packaging upon delivery and note any damage with the carrier before signing.

8) Freight & Oversized Shipments (High-Ticket Equipment)

Some items ship on pallets or in crates and require curbside or dock delivery. Inside delivery, assembly, or white-glove services are not included unless explicitly purchased. The consignee is responsible for unloading arrangements and any lift-gate services if not included.

9) Returns & Exchanges

We offer a 15-day return window for most new, unused items in original packaging. To start a return, contact support@flathat.com with your order number. Returns may be subject to restocking and return freight costs. Items showing wear, installation marks, missing accessories, or damaged packaging may be refused or incur deductions. Some products are non-returnable once opened due to hygiene, software licensing, or manufacturer policy. See details in our Refund Policy.

10) Cancellations & Pre-Orders

Pre-orders or made-to-order items can often be canceled before they enter fulfillment; after that point, standard return rules apply. Lead times are estimates and can change due to manufacturer constraints.

11) Warranties

Unless stated otherwise, products are covered by the manufacturer’s warranty. We will assist with warranty claim intake as a courtesy; however, the manufacturer determines eligibility and remedy. Warranty coverage varies by product—refer to the product page and included documentation.

12) Technical Use & Compatibility

Professional simulation products may require specific computers, operating systems, driver software, and mounting hardware. Verify compatibility and power requirements before purchase. We are available at support@flathat.com to help with pre-purchase technical questions.

13) Prohibited Uses

You agree not to misuse the Services, interfere with security features, scrape or harvest data without permission, or use the site for unlawful purposes.

14) Intellectual Property

All content, trademarks, logos, and product photography on the site are owned by Original Brands, Inc. d/b/a FlatHat Performance or used with permission. You may not reproduce or distribute content without prior written consent.

15) Third-Party Links

We may link to third-party websites or documentation. We are not responsible for the content or practices of those sites.

16) Errors, Inaccuracies & Omissions

From time to time, the site may contain typographical errors or omissions related to product descriptions, pricing, availability, or shipping information. We reserve the right to correct any errors and to cancel orders impacted by such errors with a prompt refund.

17) Limitation of Liability

To the maximum extent permitted by Tennessee law, FlatHat Performance will not be liable for indirect, incidental, special, or consequential damages arising from the use of the Services or products purchased. Our total liability for any claim relating to a purchase will not exceed the amount you paid for that purchase.

18) Indemnification

You agree to indemnify and hold harmless Original Brands, Inc. d/b/a FlatHat Performance from claims arising out of your misuse of the Services or violation of these Terms.

19) Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-laws principles.

We may update these Terms periodically. The “Last updated” date will appear at the top of this page. Continued use of the Services constitutes acceptance of the updated Terms.
